CDW, 14 Employer Organizations File Amicus Brief Urging Board to Abandon Cemex
On September 10, the Coalition for a Democratic Workplace and 14 other employer organizations filed an amicus brief before the National Labor Relations Board, urging the Board to abandon its Biden-era Cemex precedent.
The following statement can be attributed to CDW Chair Kristen Swearingen:
“Secret ballot elections are the gold standard for determining whether workers want union representation, but the Cemex decision displaced that process without justification. Under the Cemex standard, employees lose their private vote and therefore their voice in the workplace, while employer speech is chilled. The decision was contrary to the NLRA, Supreme Court precedent, and the basic tenets of workplace democracy. We urge the Board to abandon the Cemex standard and safeguard secret ballot elections.”
