CDW Reiterates Concerns about Cemex Following Fraud Allegations, Urges Board Issue Rulemaking

On April 7, CDW submitted a supplement to our previous petition for rulemaking urging the NLRB to rescind its Cemex decision and restore the pre-Cemex framework for union-representation procedures. Our supplement highlights a proceeding currently before the NLRB, Amazon.com Services LLC, in which sworn testimony raises serious questions about whether union authorization cards were forged, illustrating precisely the dangers that Cemex creates.

The following can be attributed to CDW Chair Kristen Swearingen:

“This case illustrates exactly why card check cannot be trusted as a reliable basis for union authorization and why the standard created in Cemex is so dangerous. Card check is easily manipulated and leaves workers without a voice in their workplace, while Cemex allows card check to force a union on workers without their support or consent. The Board should issue a rulemaking to rescind Cemex and restore the secret ballot as the foundation of workers’ right to genuine free choice.”
