CDW Calls on Court to Uphold Firing of Gwynne Wilcox
On March 29, the Coalition for a Democratic Workplace filed an amicus brief in Wilcox v Trump before the US Court of Appeals for the DC Circuit, calling on the court to uphold President Trump’s firing of Gwynne Wilcox. The brief explains, “the President enjoys unrestricted authority to supervise officials who exercise executive power on his behalf—including, if he sees fit, by removing those officials at will.” Supreme Court precedent in Humphrey’s Executor does not apply in this case, because the NLRB possesses substantial executive power, which has significant coercive effect on the regulated community.

“President Trump had every right to fire Gwynne Wilcox from the NLRB. The Board has significant power over the regulated community, workers, and the economy generally, and over the past several administrations, the impact of the Board’s decisions and regulations have had devastating consequences. The Trump administration is now lawfully exercising its right to bring this rouge agency back under the control of the executive branch, which President Trump alone directs.”
