CDW Files Brief Criticizing NLRB for Violating First Amendment

On March 19, 2025, the Coalition for a Democratic Workplace, along with Associated Builders and Contractors, National Federation of Independent Business, National Retail Federation, and U.S. Chamber of Commerce, filed an amicus brief before the U.S. Court of Appeals for the 11th Circuit in Amazon v NLRB, highlighting how the National Labor Relations Board is violating the First Amendment by banning employers from discussing unionization with their employees during mandatory meetings.

The following can be attributed to CDW Chair Kristen Swearingen:

“The Board’s decision in this case was an effort to silence employers during union campaigns. By trying to placate unions, the Board is muzzling employers and leaving workers without all the information they need to make a fully-informed decision about union representation. We hope the 11th Circuit will see through the Board’s nonsensical arguments in this case and uphold the First Amendment’s free speech protections.”
