CDW Questions Constitutionality of NLRB in New Amicus Brief

On October 15, CDW and several other organizations filed an amicus brief before the U.S. Court of Appeals for the 5th Circuit in Amazon.com Services v NLRB, questioning the constitutionality of the NLRB’s current structure.

The following statement can be attributed to CDW Chair Kristen Swearingen:

“The NLRB’s current structure prevents parties from having access to a jury and insulates Board members from the president’s supervision. These are clear violations of the Constitution. CDW urges the Circuit Court to recognize these irredeemable flaws and protect parties’ constitutional rights.”
